Terms of use

1. Purpose

These terms of use (hereinafter the “Terms of Use”) set out the rules for accessing and using the website orbelune-astro.com, its free content and the member area (hereinafter together “the Service”), published by Yoel Khalifa EI (trading name: Orbelune). They apply to every visitor and every member. The paid subscription is also governed by the terms of sale.

Use of the Service constitutes acceptance of these Terms of Use. Creating an account requires their express acceptance.

2. Access to the Service

The Site is accessible free of charge to any visitor with internet access. Some content (full horoscopes, birth chart interpretation, personalised deliveries) is reserved for subscribed members. Connection and equipment costs are borne by the user.

The Service is reserved for persons aged at least 18. By creating an account, the user declares that they meet this condition.

3. Member account

Creating an account requires a valid email address and a first name. The date of birth is required to determine the star sign; the time and place of birth are optional and make it possible to calculate the rising sign and the birth chart. The user undertakes to provide accurate information and to keep it up to date.

The account is strictly personal. The user is responsible for keeping their login credentials confidential (access to their email inbox and, where applicable, password) and for all activity carried out from their account. Any unauthorised use must be reported without delay to bonjour@orbelune-astro.com. Only one account per person is permitted.

4. Rules of use

The user undertakes to use the Service fairly and, in particular, not to:

• extract, copy on a large scale or collect by automated means (bots, scraping) the content of the Site;
• resell, redistribute or make available to third parties content reserved for members;
• undermine the security or proper functioning of the Service (intrusion, overloading, distribution of malicious code, circumvention of technical measures);
• impersonate a third party or provide a third party’s birth details without their consent;
• get around the rules of the free trial or of the referral programme (multiple accounts, fake referrals);
• send unlawful, abusive or defamatory messages, or unsolicited advertising, via the contact form.

5. Content generated with the help of artificial intelligence

In the interests of transparency, Orbelune informs users that horoscopes, interpretations and answers to questions are written with the help of artificial intelligence (the Claude API provided by Anthropic). These texts are produced from real astronomical calculations (planetary positions, aspects, lunar phases) and governed by editorial rules defined by Orbelune: a kind tone, no alarmist predictions, and a ban on any medical, financial or legal advice.

Neither the user’s name, nor their email address, nor their date, time or place of birth is sent to the artificial intelligence provider. For star sign horoscopes, only the sun sign and, where applicable, the rising sign are used; for personal content, the calculated positions of the chart (signs, houses and aspects of the planets). For “Questions for Orbelune”, the text of the question and of the three previous exchanges is also sent: the user is asked not to include any information that could identify them or a third party. Despite the care taken, a text may occasionally contain an inaccuracy; the user may report it to bonjour@orbelune-astro.com.

6. Nature of the content

Astrology is not an exact science. Orbelune content is offered for entertainment and personal development purposes. It does not constitute a diagnosis, a certain prediction, or medical, psychological, financial, legal or professional advice, and cannot replace the opinion of a qualified professional. Anyone experiencing health difficulties, particularly psychological ones, is encouraged to consult a health professional.

7. Intellectual property

All elements of the Service (texts, horoscopes, interpretations, illustrations, logos, the Orbelune trade mark, visual identity, software, databases) are the property of Yoel Khalifa EI (trading name: Orbelune) or are used with the permission of their owners. Content is made available to the user for strictly personal and non-commercial use, for as long as they have access to the Service.

By way of exception, the user may share on their social networks the share cards (“to share” images) offered by the Site, without modification and keeping the Orbelune credit. Any other reproduction, distribution or exploitation, in particular for commercial purposes, requires the prior written permission of Yoel Khalifa EI (trading name: Orbelune).

8. Availability of the Service

Orbelune endeavours to keep the Service accessible 24 hours a day, 7 days a week and to send content at the time chosen by the member, without being able to guarantee this absolutely. The Service may be interrupted, in particular for maintenance or updates, or in the event of an incident affecting a technical provider. Deliveries also depend on third-party services (the user’s email provider, telephone operators, browser notification services) over which Orbelune has no control.

9. Liability

Orbelune uses reasonable means to provide a quality Service. It cannot be held liable in the event of use of the Service that does not comply with these Terms of Use, fault on the part of the user, an unforeseeable and insurmountable act of a third party or force majeure, nor for decisions the user may take on the basis of the astrological content. Links to third-party websites are provided for information purposes; Orbelune has no control over those websites.

These limitations apply to the extent permitted by law and do not deprive a consumer user of the rights conferred on them by the mandatory provisions of the French Consumer Code, in particular the legal guarantee of conformity of digital content and services.

10. Closing your account

The user may delete their account at any time from their member area, on the “Profile” page. Deleting the account results in the cancellation of any subscription and the erasure of data under the conditions set out in the privacy policy. Users are advised to export their data beforehand.

In the event of a serious breach of these Terms of Use, Orbelune may suspend or close the user’s account, after informing them by email and, except in an emergency or in the case of fraud, giving them the opportunity to submit their observations. Accounts that have been inactive for three (3) years are deleted after prior notice by email.

11. Changes to the Terms of Use

Orbelune may amend these Terms of Use to reflect changes to the Service or to the regulations. Members are informed by email of any material change before it comes into force. Continued use of the Service after that date constitutes acceptance of the amended Terms of Use; otherwise, the user may delete their account.

12. Governing law

These Terms of Use are governed by French law. The procedures for settling disputes, including recourse to consumer mediation, are set out in the terms of sale. For any question: bonjour@orbelune-astro.com.
